True2Soul Network Inc. (“True2Soul”)
1. HOW TO ENTER No purchase required. To enter the Scavenger Hunt, participants must be True2Soul Community or Professional Network Members (Member), and submit entry during the Contest Period. Submit your answer to firstname.lastname@example.org via e-mail, including your name and telephone number. To be valid your entry must be received by 9:00pm EDT on April 15, 2019. Limit of one entry per Member. If you attempt or are suspected of attempting to enter more than once or use robotic, automatic, programmed or any entry methods not authorized by these rules, it shall be deemed as tampering and will void your entries.
2. ELIGIBILITY Scavenger Hunt is open to all residents of Ontario who are 16 years of age or older at the Scavenger Hunt opening date. For any participant who has not reached the age of majority, parent or guardian consent is necessary to enter the Scavenger Hunt. Where appropriate, the terms “participant” and “winner” mean parent or guardian of that person. Employees, volunteers and consultants of True2Soul Network, as well as such employees’, volunteers’ or consultants’ immediate family (father/mother, brother/sister, son/daughter) or persons living under the same roof are not eligible to enter this Scavenger Hunt.
3. PROCEDURE FOR AWARDING PRIZES On April 21th, 2019, the winner will be chosen from among all eligible entries received during the Contest Period, and announced at true2soul.com (Website). The first participant to submit the most correct answers to the Scavenger Hunt questions and correctly answer the mandatory mathematical skill-testing question shall be declared the winner, subject to meeting all the conditions described in these rules. Winner will be contacted by telephone or e-mail during the week following the draw and should claim their prize as instructed by True2Soul by no later than five days after the date they are initially contacted. If a winner cannot be reached within three days following the first attempt of contact, incorrectly answers the mathematical skill-testing question, declines the prize, or fails to return the required release form, the prize shall be forfeited and True2Soul has the right, at its sole discretion, to select another winner. Prize is available for pick-up at either True2Soul location (Toronto or Durham Region, Ontario). Shipping can be negotiated with prize winner – who would bear sole responsibility for all applicable shipping fees, custom fees, taxes and duties.
4. DESCRIPTION OF PRIZE The winner will receive one True2Soul Self-Care Gift Basket. The total approximate retail value of the prize is $70.00 CDN.
5. GENERAL RULES
i) To be declared a winner, the selected participant must first correctly answer a mathematical skill-testing question.
ii) Each winner shall sign a release declaring their eligibility as stipulated in Section 2 of these rules; agreeing that their name, image and/or voice may be used for advertising purposes related to this Scavenger Hunt free of charge; and releasing True2Soul as well as its respective directors, officers employees and volunteers (the “Contest Parties”) from all liability for any damage or loss arising from participation in this Scavenger Hunt or from the awarding, acceptance or use of the prize.
iii) The prize shall be accepted as is and may not be exchanged or refunded for an amount of money, sold or transferred. No substitutions will be allowed. Any unused portion of a prize will be forfeited.
iv) If the prize cannot be awarded as described in these rules, True2Soul reserves the right to substitute a prize or prize component with another of comparable value, as determined in its sole discretion.
v) Refusal to accept the prize releases the Contest Parties from any obligation toward the winner.
vi) If a participant makes any false statement, (s)he will be automatically disqualified from the Scavenger Hunt.
vii) The Contest Parties assume no liability for any loss, damage or injury, including without limitation: (a) lost, stolen, delayed, damaged, misdirected, late, destroyed, illegible or incomplete entries; (b) loss, theft or damage to software or computer or telephone data, including any breach of privacy; (c) fraudulent calls; (d) inability of any person to participate in the Scavenger Hunt for any reason including mistaken addresses on mail or e-mail; technical, computer or telephone malfunctions or other problems with computer on-line systems, servers, access providers, computer equipment, or software; congestion on the internet or at any website, or any combination of the foregoing; (e) damage to any person’s computer, including as a result of playing or downloading any material relating to the Scavenger Hunt; (f) any delay or inability to act resulting from an event or situation beyond their control, including a strike, lockout or other labour dispute at their location or the locations of the organizations and businesses whose services are used to administer this Scavenger Hunt; or (g) prizes that are lost, damaged or misdirected during shipping.
viii) True2Soul reserves the right to cancel or suspend this Scavenger Hunt should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Scavenger Hunt. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Scavenger Hunt is a violation of criminal and civil laws. Should such an attempt be made, True2Soul reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
ix) All personal information, such as name and contact information, is collected by True2Soul solely for the purposes of administering this Scavenger Hunt and shall not be used for any other purpose without your express consent. By providing this information, you consent to it being used for the stated purposes.
x) If the identity of a participant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the contestant. The individual assigned to the e-mail address for the domain associated with the submitted email address is considered the authorized account holder. A selected participant may be required to provide proof that (s)he is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Scavenger Hunt will be the Scavenger Hunt server.
xi) Odds of winning depend on the number of eligible entries and date/time of submission. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, using any robotic, automatic programmed method that artificially increases the odds of winning or do not conform to or satisfy any condition of the rules may be disqualified by True2Soul. True2Soul is not responsible for any errors or omissions in printing or advertising this Scavenger Hunt.
xii) True2Soul reserves the right to amend the Scavenger Hunt rules or to terminate the Scavenger Hunt at any time without any liability to any participant. Any amendments to these Scavenger Hunt rules will be posted on this page
xiii) By entering, you agree to abide by the Scavenger Hunt rules and the decisions of True2Soul, which decisions are final and binding on all participants.
The True2Soul Privacy Code is a formal statement of principles and guidelines concerning the requirements for the protection of personal information provided to True2Soul Network by its staff, network members, customers and clients. True2Soul strives to provide the best service possible. This means handling your personal information with transparency, integrity and fairness.
The purpose of True2Soul’s Code of Privacy is to maintain transparent practices in its management of personal information in keeping with applicable Canadian legislation. Our Code of Privacy tells you how we protect your privacy and the confidentiality of your personal information.
Personal Information is defined as any piece of information, either factual or subjective, about an identifiable individual. Personal Information does not include the name, title, business address, business email or business telephone number of an employee of an organisation.
3.1 When you submit a registration form we ask you to provide certain information about yourself by filling out and submitting this online form. It is completely optional for you to engage in this process. If you elect to complete your submission, we may ask that you provide us personal information, such as your first and last name, mailing address (including postal/zip code), email address, contact numbers, and other personal identifying information. Some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data, you will not be able to successfully submit your form.
3.2 When you submit personal information to True2Soul, you understand and agree that this information may be stored and processed in any of the countries in which True2Soul and its affiliates and subsidiaries maintain offices, including without limitation, the United States and Canada. You also acknowledge that in certain countries or with respect to certain activities, the collection, transferring, storage and processing of your information may be undertaken by trusted vendors of True2Soul Network.
3.3 True2Soul Network will not knowingly disclose your personal information to third parties without your consent. We may disclose user information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) True2Soul Network rights or property, website users, or anyone else that could be harmed by such activities. True2Soul may disclose user information when we believe in good faith that the law requires it.
3.4 True2Soul Network may share aggregate information about our users with advertisers, business partners, sponsors and other third parties. For example, we will say True2Soul Network audience is x percent in a specific industry and y percent in another specific industry. This data is used to customise True2Soul Network site content, marketing and to deliver a better experience for our users.
3.5 The personal information that you provide in connection with registering yourself as a participant in True2Soul Contests is classified as Participant Information. Participant Information is protected in several ways. Your Participant Information resides on a secure server. Personal information that you provide that is not Participant Information also resides on a secure server. Since this information is not accessible from outside True2Soul Network, you will not be asked to select a password in order to view or modify such information. Please note that any information you post to any public bulletin board, guestbook or forum is available to all persons accessing any of our sites.
3.6 Information provided at the time of Product Purchase, Product or Service Registration or submission of Contact, Membership or Support forms may be used for marketing and promotional purposes by True2Soul Network, our affiliates, resellers or companies associated with True2Soul Network. To keep you in control of your personal information and the communications directed to you, we request you opt into any of the following services: sharing your information in our Network Directory, receiving communications from True2Soul Network about new updates, products, services and/or specials. If a Network Participant objects to such use for any reason, she or he may stop that use by e-mail request to email@example.com. Information provided when purchasing products from any of our online stores may be used for marketing and promotional purposes and is subject to the opt-in processes described on, or linked to, each form.
3.7 True2Soul Network Web Site and Professional Directory may contain links to other sites. We do not endorse or otherwise accept responsibility for the content or privacy policies of those sites. Additionally, some of our Web pages may contain “cookies”, which are data that may be sent to your Web browser and stored in your computer. This allows our server to “recognise” you when you visit our Website in the future. These cookies do not contain personally identifying information. Most web browsers can be configured to not accept cookies, or to notify you if a cookie is sent to your device.
3.8 The Ten Principles of Privacy, developed by the Canadian Standards Association, form the basis of True2Soul’s fair information practices and outline True2Soul’s commitment to protecting your privacy.
Every True2Soul Network associate is responsible for maintaining the confidentiality of all information to which they have access. Our associates are informed about the importance of privacy and receive ongoing updates on privacy related policies.
In addition to establishing the Code of Privacy, we have appointed a Chief Privacy Officer who is responsible for overseeing the personal information handling practices at True2Soul Network and ensuring we are in compliance with our Code of Privacy and related policies.
b. Identifying Purposes: Why we collect information
When we need to collect personal information from you, we will identify the purpose for the collection at or before the time we collect it. We will only collect the information needed to fulfill the service we have identified and for no other purpose. If we wish to use your information for any other purpose we will obtain your consent.
We ask for your personal information for the purposes of registration and/or in order to meet your membership, service or product needs, as well as to establish a lasting relationship with you.
The information we ask for depends on which services or products you require from or the nature of your engagement with True2Soul. For example, we may request your personal information to:
· Better understand your needs
· Provide you with a specific service and/or product
· Provide you with information and offers on our products and services
· Comply with law
True2Soul seeks your consent to collect, use or disclose your personal information at the time of collection or in advance. We have taken steps to ensure that our language is clear and understandable so that you know why we are collecting your information and how we will use it.
Consent may be expressed in writing or it may be implied in the circumstances. In addition to writing, your consent may also be expressed verbally or electronically.
In general, you can choose not to provide us with some or all of your personal information at any time. However, should you make this choice we may not be able to provide you with the product, service or information that you requested or that could be offered to you. Upon request we will explain your options of refusing or withdrawing consent to the collection, use, and disclosure of your personal information.
d. Limiting Collection
True2Soul does not collect personal information indiscriminately. Rather, we limit our collection of personal information to only what is necessary for the purpose we have identified. We employ fair and lawful means in the collection of personal information.
e. Limiting Use, Disclosure and Retention
True2Soul will use or disclose your personal information for the purpose for which it was collected, except with the consent of the individual or as required by law.
We will retain personal information only for as long as required to fulfill the identified purpose. Once your personal information is no longer required, it will be destroyed or made anonymous.
At True2Soul Network, we endeavour to keep our personal information complete, up-to-date and accurate. While we do our best to ensure our information is accurate, we do rely on individuals to inform us of any relevant changes in their personal information.
Should you discover, upon review of your personal information, that amendments are required, please advise us. If the requested change is accepted, the personal information will be modified in accordance with your request as soon as possible and you will receive a copy of the amended portion of the record.
When a correction or amendment has been made to a personal record, True2Soul will, where appropriate, send a copy of the correction to any persons or organizations that have access to the information in question.
g. Safeguards: Protecting your information
We employ appropriate safeguards to make certain that your personal information is protected from loss or theft as well as from unauthorized access or disclosure.
The information we collect is retained on True2Soul Network premises, other than where you have consented to its release or such release is required by law.
h. Openness: Keeping you informed
i. Providing Access
True2Soul will provide you with access to the information it retains about you upon receipt of a written request and satisfactory identification.
Upon written request and satisfactory identification, we will also correct or amend any personal information if its accuracy and completeness is found to be deficient.
There are some instances where True2Soul will not be able to provide an individual with the requested information. Some of these instances include where the information:
· Consists of references to other persons that cannot be otherwise severed
· Is subject to solicitor–client privilege
· Contains confidential True2Soul Network proprietary information
· Has already been destroyed due to legal requirements or because it was no longer needed for the identified purpose
If True2Soul is unable to provide you with the information you have requested, the reason for the refusal will be explained in writing.
j. Challenging Compliance
We have prepared our Code of Privacy to keep you informed of our commitment to protecting your privacy.
